Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the https://azeemfitness.com website (the “Service”) operated by Azeem Fitness. (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

Purchases

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

The service may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

Restocking Fees

Orders canceled after 24 hours will be subject to a restocking fee of 20%

Abandonment of Equipment

Equipment not picked up from the Azeem Fitness warehouse located at Main Rashid Minhas Road opp Aladin Park, Karachi after 07 days will be subject to being resold without any refund, reimbursement, or compensation to buyer.  

SALES – USED EQUIPMENT

 Purchaser understands that the Goods described herein have been used by persons other than Seller. Purchaser is warned and acknowledges that such Goods may bear or contain hazardous chemicals or electrical hazards ,hazardous materials which may be or may become, by chemical reaction or otherwise, directly or indirectly hazardous to life, to health, or to property (by reason of toxicity, flammability, explosiveness or for other similar or different reasons during use, handling, cleaning, reconditioning, disposal or at any other time after the article leaves the possession and control of Seller). Purchaser does hereby discharge Seller from any and all liability directly or indirectly resulting from the presence of the aforesaid chemicals or materials, including and not limited to any and all liability directly or indirectly resulting from the failure of Seller to give more specific warning with respect to individual articles or substances or from the inadequacy of any warning.

Copyright Policy

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to info@azeemfitness.com with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below, under “DMCA Notice and Procedure for Copyright Infringement Claims”

WARRANTY

All our used products carry a checking warranty of 24 hours from the date of invoice for any manufacturing defects arising out of faulty or defective materials or workmanship. All Warranty is Valid only in Pakistan & has to be sent back to us freight prepaid for repairs or replacement. The products will be rectified and delivered within Karachi only.

The warranty terms are void in case of any of the following:

• The product is damaged by physical abuse, improper handling, reckless use or negligence of the user;

• Any repairs or modifications are attempted on the product by unauthorised persons.

• The Warranty seal on the rear cover of the product is removed or tampered with

• The serial number of the product is deleted, defaced or altered.

• The warranty terms are void if the counterfoils printed in the instruction manual sent to the customer along with the product is not duly filled and returned to us within fifteen days from the date of purchase.

“We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time”

Return and Refund Policy

To be eligible for a return, please make sure that:

    The product was purchased in the last 24 hours

·         The product is in its original condition

·         The product isn’t used or damaged

·         You have the receipt or proof of purchase

Products that do not meet these criteria will not be considered for return.

Limitation Of Liability

In no event shall Azeem Fitness, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

The Service and its original content, features and functionality are and will remain the exclusive property of Azeem Fitness, and its licensors. The Service is protected by copyright, trademark, and other laws of both the Pakistan and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Azeem Fitness.
